Complex e-bike liability
Many e-bike cases involve more than two people. Here's how responsibility is usually sorted out.
Minor & teen riders
Children are judged by what's reasonable for their age. Parents may be liable for willful misconduct (in California, Civil Code 1714.1), negligent supervision, or giving a child an unsafe or over-powered bike.
Delivery couriers
Whether the rider is an employee or contractor affects workers' comp and whether the delivery company can be responsible for a crash the rider causes.
Pedestrian accidents
Pedestrians hit by e-bikes may claim against the rider, the rider's employer, a bike-share operator, or household insurance. Speed and location rules matter a lot.
Comparative fault
California and New York both use pure comparative fault: your compensation is reduced by your share of blame but not eliminated. Don't assume you have no case because you made a mistake.
